As we already have informed you an amendment to the German Telecommunications Act (TA) will become effective. This amendment will include provisions of consumer protection, waiting loops, caller rate announcements, transparency and billing.
Article 3 of the TA contains the definition of the term “waiting loops”.
The below provisions of free waiting loops do not affect
- calls to 0800 numbers,
- calls to landline numbers,
- calls to ordinary mobile phone numbers,
- calls, which are billed at a fixed price per call (e.g. calls from the fixed network to 0180-2 and 0180-4 numbers) and
- calls from abroad.
I. Phase 1 from September 1st, 2012 to May 30th, 2013:
From then on all waiting loops at 0180, 0700, 0900 and 118xy numbers at the beginning of a call have to be free of charge for the caller. The maximum duration of such a waiting loop is 2 minutes.
Waiting loops during the further course of connection can be charged without time limit.
In case of breaching these provisions penalties up to EUR 100.000,-- might be imposed (in special cases this limit could be even exceeded)
II. Phase 2 from June 1st, 2013:
All waiting loops (at the beginning of the call and later) have to be free of charge for the caller.
When a waiting loop (exempted 0800, landlines and mobile phone numbers; see above mentioned exceptions 1.-3.) is used the first time during a call the caller has to be informed at the beginning of the waiting loop if the waiting loop is free of charge or if the connection is billed at a fixed price per call. The expected duration of the waiting loop has to be announced as well.
In case of breaching these provisions penalties up to EUR 100.000,-- might be imposed. Furthermore the caller does not have to pay the costs of the whole call in case of such breaches.
